The Islander Day Act, amended the Prince Edward zIsalnd Employment Standards Act so that the second Monday in February is now to be treated the same as New Year's day, or any other paid statutory holiday.
The PEI Employment Standards Act gives seven holidays with pay to employees who qualify:
- New Year's Day
- Islander Day (2nd Monday in February)
- Good Friday
- Canada Day
- Labour Day
- Remembrance Day and
- Christmas Day.
Who Qualifies for Paid Holidays?
The employee must:
- be employed for/with the same employer for 30 calendar days prior to the holiday
- have earned wages on at least 15 of the 30 calendar days before the holiday
- have worked his/her last scheduled shift before the holiday and his/her first scheduled shift after the holiday. (This does not necessarily mean that an employee does not qualify because he/she did not work the day immediately before the holiday, eg. Sunday; if the last scheduled day of work was the Friday before the holiday Monday, and the employee worked that scheduled shift, the employee may qualify for the paid holiday).
Not all workers are covered by the paid statutory holiday provisions.
Salespersons whose income is derived primarily from commission on sales, and farm labourers are expressly excluded from the paid holiday provision under the Employment Standards Act.
So in determining how to treat employees on February 9, 2009, provincially regulated Island employers are under the same obligations as they would be for any other statutory holiday (like Canada Day).
